QUESTIONS ABOUT USING & RESELLING MY ART:

Q:  I bought I product from a reseller who used your images in compliance with your terms of use policy.  Who’s copyright terms do I follow?

A:  By allowing resellers to use my art to create new products for resale, I in no way have surrendered my copyrights or allow resellers to reassign my copyright terms!

Q:  I downloaded your copyrighted art from an online sharing group claiming they have the right to do so under the “Fair Use” copyright law. Is this correct?

A:  Absolutely, positively NOT!  Section 107 of the Copyright Act (title 17, U. S. Code   specifies "fair uses" such as criticism, comment, news reporting, teaching, scholarship, and research acceptable.  If you are using the art as such YOU MUST obtain a written permission statement from me along with your written and signed statement of usage intent.  Acknowledging the source of the copyrighted material does not substitute for obtaining permission.  More info on Fair Use can be found on the US Copyright Office website.

Q:  I’ve read through your Terms of Use several times and still don’t understand them.  Can I use the art to sell items in my online store or not?

A:  You may use the art to create items in your store IF you purchase the original art from me, If you are not a commercial manufacturer/distributor, IF you "new Product incorporates my art and is not being sold “AS IS” and IF you visibly credit me as the copyright owner of the original art and post that credit with link on the product page.

Q:  I create decoupage sheets for resale.  Is this allowed under your terms of use?

A:  Flattened "As Is" images from my products and then sold as decoupage or sticker pages is merely duplication and not considered as a "new product" and is not compliant with my Terms of Use.  CLICK HERE to see a visual sample

Q:  I’m an embroidery digitizer.  Can I use your work to make embroidery collections to resell in my online store?

A:  Like digi-scrappers, paper craft artists, painters and cross stitchers you need to comply with my Terms of Use.  Please note that simply translating/converting my art to another medium does NOT constitute a new product!  While you may not sell my art as commercial machine embroidery software/memory cards or data files, you may sell “new compositions” you have personally created from my kits and patterns in compliance with my Terms which includes how-to instructional projects that includes art as a necessary component to complete the project.
